Other driver hasn't filed claim yet

I was just rear ended last week. I was the middle car and I was pushed into the car that was in front of me. To make matters worse, the driver who hit me was driving her friend's car and that car is insured under Farmer's. The car in front of me is insured by Farmer's as well. It's been a little over a week and the girl who hit me still has not reported the claim. Whose responsibility is it to file the claim? I know the claim is filed against the name of the insured but the girl who was driving still hasn't called Farmer's or my State Farm ins co to give her account of what happened. I called my claims team today and they said letters have gone out to both drivers with no success. Apparently, there is some communication issues between the name of the insured and her friend, the driver of the car. Does it sound like the driver of the car who hit me is stalling or ignoring the situation? Or am I jumping the gun at this point? If she does ignore this accident, what are my options? I only have liability and uninsured motorist. I'm a full time nursing student and am only able to work the weekends which doesn't leave me with much to pay for the repairs myself so I would like to get things rolling ASAP. I needed that car to last me until I graduated and this was the last thing I needed. It's drivable but I am hesitant to do so because I don't want to make things worse. So again to recap, my questions are: - Regarding the car who hit me, between the driver and name of the insured, who is responsible for reporting a claim? - If the DRIVER who hit me refuses to communicate with the insurance companies, can we still move forward? Or is it pretty much stalled if she doesn't give her account of what happened? Where does the police report play into this?

this is sooo sad because i just experienced also the very same situation. state farm has been my provider for over 15yrs and right now i am not a happy at all with the way they are handling my situation...its crazy that they take our money all these years and NEVER had an accident until now and it wasnt even my fault!!!!!for state farm not to have my back and b considerate of the fact that i have a sick child that i need to take to doctors visits 3 times a week, plus i have FULL coverage coverage ohhhh not to mention state farm told me there was no such thing as uninsured motorist and for them to not contiune to pay for my rental expense and go for the other insurance is so jacked up!!!!! (sick child) i am soo stressed and this is dead wrong. what am i to do???????

Can't you always just contact your own insurance company, regardless of who is at fault? I always thought that I would contact my company, they would pay me for my damages, and then they would track down the other driver's insurance company to get paid back. If someone else caused the accident, do I always have to go through their company?

I can understand why youíre frustrated. One of the duties under an insurance contract is the duty of the policyholder to give notice of the loss as soon as reasonably possible to the insurance company. The person who owns the car that rear-ended you should report the loss to their insurance company. Another duty is for the insured to cooperate with all aspects of the investigation. Each state requires an insurance provider to investigate claims within a reasonable time and advise the parties of its claim decision.

If it appears that the responsible person doesnít have insurance, and if you have purchased uninsured motorist coverage you may be covered under your policy. You should contact your agent regarding questions about this coverage.
